1. Scope of Application
The General Terms and Conditions (GTC) apply to all orders placed and contracts concluded via the online shop of pureorganics.ch.
PureOrganics reserves the right to change the GTC. The version of the GTC valid at the time of the order applies and cannot be changed unilaterally for this order.

2. Offer
The offer is aimed at private customers residing, or corporate customers based, in Switzerland or Liechtenstein. Deliveries are made only to addresses in Switzerland or Liechtenstein.
The offer is valid as long as it is visible in the online shop and/or while stocks last. Price and product range changes are possible at any time.

3. Price
The prices are in Swiss Francs (CHF), excluding value-added tax (VAT).
The price in the online shop at the time of the order is decisive.

4. Payment
Payments must be made in Swiss Francs (CHF).
If advance payment is agreed, payment is due immediately after the conclusion of the contract.
Credit cards (Visa & Mastercard) are accepted as payment methods.

5. Order/Contract Conclusion
An order is considered an offer to pureorganics.ch to conclude a contract.
A minimum order value of CHF 40.00 applies per order. For the first order, the total shopping cart value must not exceed CHF 1,000.00.
After the order is submitted, the customer automatically receives an order confirmation, documenting that the order has been received by pureorganics.ch.
PureOrganics is free to reject orders in whole or in part without stating reasons. In this case, the customer will be informed, and any payments already made will be refunded. Further claims are excluded, particularly no subsequent delivery of unavailable products. Temporarily unavailable products cannot be reserved.

6. Delivery
Delivery is made within 2-5 days by Swiss Post. Shipping costs are CHF 14.00 for A-Post and CHF 12.00 for B-Post. Shipping is free for orders over CHF 200.00.
There are no deliveries on Sundays or official national or cantonal holidays.
Shipping costs are listed as an additional item in the shopping cart and on the invoice.

7. Warranty
The seller guarantees that the products are undamaged at the time of dispatch. Products damaged during shipping will either be repaired or replaced, provided the customer notifies the seller in writing within 8 days of receiving the goods. If requested by the seller, the customer must return the damaged products in their original packaging to the seller promptly. The seller is liable for damages to the customer insofar as such liability arises from the Product Liability Act. Any further warranty for the delivered products and any liability for damages caused by these products are excluded unless the seller has fraudulently concealed the defects. If the seller has further warranty claims against their suppliers for the respective product, the seller will assign these claims to the customer upon request, where possible. The seller assumes no responsibility for successfully enforcing these claims. The same applies to claims the seller may have against Swiss Post for damages during transport.
The seller makes no warranty that the products are suitable for the customer's intended use or will achieve a particular result. Also excluded from the warranty are damages caused by the customer, e.g., improper handling or damages caused by external influences not attributable to the seller, such as damages that occurred during transport.
Once Swiss Post has delivered the package to the customer (including leaving it in the milk box or in front of the door), it is considered delivered. If the package is delivered by the post but not received by the buyer, it is considered theft.

8. Returns
If the customer wishes to return products, they can submit a request for a return to the seller within 14 days of receiving the goods. Whether the seller agrees to such a return is at the sole discretion of the seller. There is no obligation to accept returns. Any consent to a return will be communicated to the customer within 48 hours. Returned products will only be accepted if they are in their original packaging, unused, and undamaged. The customer must bear the cost of return shipping. In the case of a return, shipping costs may be recalculated based on the value of the goods.
The customer has a right of withdrawal under the following conditions: The customer is any natural person concluding a legal transaction for purposes predominantly outside their trade or independent professional activity. The customer has the right to withdraw from the contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the customer or a third party named by them, who is not the carrier, took possession of the last goods. To exercise the right of withdrawal, the customer must inform the seller via a clear declaration (e.g., a letter sent by post or an email) about their decision to withdraw from the contract. It is sufficient if the customer sends the notice of withdrawal before the withdrawal period expires.
If the customer withdraws from the contract, the seller must refund all payments received from the customer, excluding delivery costs, without delay and at the latest within fourteen days from the day the seller received the withdrawal notification. The seller will use the same means of payment the customer used for the original transaction unless expressly agreed otherwise; in no case will the customer be charged for this refund. The seller may withhold the refund until they have received the goods back or the customer has provided proof that they have returned the goods, whichever occurs earlier. The customer must return or hand over the goods to the seller without undue delay and in any case no later than fourteen days from the day on which they notified the seller of the withdrawal. The deadline is met if the customer sends the goods before the period of fourteen days has expired. The customer must avoid damage to and contamination of the goods and their original packaging. All goods opened or used by the customer are excluded from the right of withdrawal for hygienic reasons. The goods, including their original packaging and all accessories, must be returned to the seller.
